Accused freeway shooter Leslie Merritt Jr. is out of jail on $0 bond. His attorney, Jason Lamm, argued in Maricopa County Superior Court that a sealed motion calling into question the prosecution’s ballistics evidence against Merritt has been rendered baseless.

Merritt could hardly contain himself, all smiles and almost jumping for joy before court began. Lamm says Merritt has suffered through this ordeal, having missed holidays and even his daughter’s 1st birthday and they are pleased to have won him his limited freedom. Lamm notes that, while his client is being released from jail, the case has not been dismissed and Merritt is still facing serious criminal charges and will have to wear an electronic monitor for location only. Merritt still faces 15 charges linked to numerous freeway shootings in the Phoenix area last summer. The defense has maintained that the gun prosecutors claim was used in the attacks was locked up at a pawn shot at the time in question.
