Arizona Attorney General Mark
Brnovich is filing a petition for special action with the State Supreme Court
to remove Arizona Corporation Commission Chair Susan Bitter Smith from office
due to a conflict of interest. 

Brnovich says
his investigation confirms that Bitter Smith draws an $80,000 salary as Corporation
Commission Chair and another $150,000 annually from a cable trade group and
that clearly shows that she should have never been elected to the office in the
first place.  In a written statement from
her lawyer, bitter smith says this complaint is politically motivated and
denies there is a conflict but Brnovich says there is nothing political about
his investigation.  Brnovich notes that
there is also a related open criminal case but declined to discuss it.
