Maricopa County Attorney Bill Montgomery is discounting
filings from attorneys for the suspect in the Phoenix freeway shootings who say
they have an alibi for Leslie Allen Merritt, Jr. and are asking the court to
release him without bail.  Montgomery
says the motion is similar to those other attorneys file for their clients and
there is nothing in it to warrant a judge’s reconsideration of bail. 

Merritt is in jail on a $1-million dollar bond
and Montgomery says the court is not obligated to revisit that decision because
bond was granted he does not have to prove guilt to keep him in jail before
trial. Merritt’s lawyers says they have cell phone records and an alibi that
put him well away from where these crimes were committed.
