A day of reckoning comes Friday in Federal court as Maricopa County Sheriff Joe Arpaio will soon learn whether he should be criminally charged with Contempt of Court. A-C-L-U Attorney Dan Pochoda argues the Sheriff and his top aides’ behaviors rise to the level of criminal conduct. Including, he says,
deliberately defying a court order to stop racial profiling and lying about it on the stand. The defendants have claimed their actions were unintentional.
Pochoda’s quick to note Federal Judge Murray snow cannot order criminal charges. He can only refer them to a prosecutor, which will likely be the U.S. attorney. But Snow has ordered removing the Sheriff from his internal affairs on racial profiling matters. That is one of the sanctions resulting from the civil contempt phase of this case. Financial compensation of the victims will also be addressed at this hearing which begins at 1 p.m.
