A judge has rejected its sentencing limitations and the plea agreement entered for a Kingman man charged in two assault cases, one of them deadly. Mohave County Superior Court Judge Lee Jantzen rejected as too lenient the five year prison term mandated in the plea deal for David James, 34.

Judge Jantzen’s July 3 decision essentially returns the case to its starting point.

Matthew Porter, 23, died several hours after he was punched in the face three times during a May, 2016 fight with James, according to deputy Mohave County attorney Greg McPhillips. The prosecutor said Porter complained of a headache and was dead when his friends returned a couple of hours after leaving him alone at his home in the 500 block of Windsor Avenue.

In addition to Porter’s death, James is also being prosecuted for allegedly assaulting a corrections officer in October,  2016.
